REPORT: The case for reforming CPO “fair value”

After almost two centuries of legislation and case law surrounding the CPO system, the radical but simple solution proposed in this report would make the issue of CPO compensation more straightforward. Much-needed investment in energy, road, rail, housing, and broadband will be easier to achieve under a fast-tracked system.

The system of calculating “fair value” for property under CPO acquisitions adds costly construction delays because of the incentive it gives owners to delay and object. Offering substantially more at the outset will reduce objections and cut overall costs
